Vermont Business Environmental Issues Involving New Property Purchases and Expansion of Existing Facilities

RED FLAGS:

Site Characteristics
* Wet Areas - potential wetlands permitting issues (ANR & Army Corps.)

*External Modifications, Contruction-Potential Act 250 Permitting Issues

*Vermont Agency of Natural Resources Permit Handbook;

* Not on town water or sewer - potential wastewater and water supply permitting issues (Change of use or increased flows & >25 employees triggers potentially extensive/expensive permitting requirements)

Potential Barriers to Expansion - non game endangered species habitat, wellhead protection zones and archeological issues

Site History and Planned Use

Previous business use - Any of the following uses may have associated environmental issues:
gas station/mini-mart; dry cleaning; auto repair; machine shop; trucking; petroleum/LP gas dealer; or any manufacturing that may have used hazardous materials.

All of the above on septic system increases liability potential.

* Underground Storage Tanks - potential liability from leakage, should be pulled and tested at seller’s expense, unless they are newer, double walled tanks and are permitted (underground heating oil tanks are also a liability)

* Planned paved areas over 1 acre - stormwater permitting issues

* Planned use of hazardous materials in a manufacturing process, especially if on septic system and over 220 lbs/mo. of materials

All floor drains in buildings (especially to septic system) - must be permitted due to potential liability from spill of chemicals, even mop water with oil or grease in it. Plug all floor drains on septic from spill of chemicals, even mop water with oil or grease in it

* Extensive/expensive Fire Code and ADA (Americans with Disabilities Act) modifications may be required for change of use on existing buildings, plus amendments to air and/or wastewater permits
